Healthcare Alert: 2018 Legislation Affecting Physicians and Patients

That’s why we spend our time and dollars supporting the AMA, the Medical Society of the State of New York (MSSNY), the FMA, and the Palm Beach County Medical Society, all of which promote legislation and health care delivery models that support physicians in doing what’s most important to them and best for their patients.

Fuoco Group would like our physician clients in both New York and Florida to be up to date on state and national advocacy efforts for meaningful legislative change directly related to the practice of medicine.

American Medical Association (AMA)
The American Medical Association advocates nationally on a broad set of issues that directly affect physician private practice, including Medicare physician payment reform, regulatory burdens, insurer practices, medical liability reform, prior authorization, opioid epidemic, telemedicine, physician wellness, etc. See the full list of AMA key issues for 2018 here.

Here’s the top AMA advocacy issues for 2018.

Regulatory wins for the AMA so far include the following.

New York State Medical Society (MSSNY)
The Medical Society of the State of New York feels access to quality and timely physician care has become more difficult as the practice climate for physicians in New York State has deteriorated. Due to an untenable economic squeeze between rising practice costs and reductions in payments, more and more physicians are being forced to close their practices and join large health systems to be able to continue to deliver patient care. Patients benefit most when physicians have a real choice as to which practice setting is best suited to them, whether that is a small group, large group, or employed by a health system. While in some cases administrative burdens may be reduced, this trend can also result in reduced patient options, elimination of jobs for non-physician support staff, and reduced physicians’ ability to be patient advocates. Worse still, many experienced physicians have indicated they may retire from practice early, further exacerbating barriers to care. MSSNY Legislative Advocacy Priorities for 2018.

Florida Medical Association (FMA)
The Florida Medical Association is tracking over 160 bills in the current legislative session.  The majority of their lobbying efforts will be focused on prior authorization, retroactive denial, maintenance of certification, telehealth, controlled substance prescribing and more. FMA Bill Watch List

FMA’s Latest 2018 legislative update for issues impacting the medical profession:
•    Efforts are continuing with Fail First and MOC bills.
•    Needle exchange legislation is moving towards passage for Palm Beach and Broward County.
•    Direct primary care is moving forward.
•    The scope of practice bills is not moving forward.
•    24-hour recovery care center and PIP bills are still under consideration.
•    Opioid legislation has not been finalized.
•    Major deliberations still underway regarding gun violence.
